OFFICIAL RULES

NO PAYMENT, ENTRY FEE OR PURCHASE REQUIRED. OPEN TO RESIDENTS OF THE FORTY-EIGHT (48) CONTIGUOUS UNITED STATES AND THE DISTRICT OF COLUMBIA (EXCLUDING ALASKA, HAWAII, PUERTO RICO, GUAM, THE U.S. VIRGIN ISLANDS AND OTHER U.S. TERRITORIES). ENTRANTS MUST BE AT LEAST EIGHTEEN (18) YEARS OLD AT TIME OF ENTRY. VOID WHERE PROHIBITED.

HOW TO ENTER: The WWE & Mountain Dew #DEWxWWE Sweepstakes (the “Sweepstakes”) begins at 10:00 AM (ET) on September 7, 2017 and ends at 12:00 PM (ET) on September 13, 2017 (the “Sweepstakes Period”). The promotion is sponsored by World Wrestling Entertainment, Inc. ("Sponsor"). Sponsor’s clock is the official time keeping device of the Promotion.

Receive an entry in the contest drawing by following both WWE and Mountain Dew on Twitter (@WWE and @MountainDew) and tweeting on the Twitter website your WWE style entrance video (subject to the content guidelines below) using the hashtags #DEWxWWE and #Sweepstakes.  Videos will not be judged to pick a winner. 

Limit of one (1) entry per person during the Sweepstakes Period. A Twitter account is required to enter this Sweepstakes.  A Twitter Account is available for free at http://www.twitter.com.  Entrance into the Sweepstakes through multiple Twitter accounts will disqualify entrant from the Sweepstakes.  All terms and conditions of Twitter.com apply.  If you choose to enter via your mobile device, standard data rates may apply. See your wireless provider for pricing plan details. Sponsor’s computer is the official time keeping device for this Sweepstakes. All entries become the sole property of WWE and will not be acknowledged or returned. Entries will be declared made by the authorized account holder of the Twitter account used at the time of entry. The authorized account holder may be required to provide proof of identity. If a dispute cannot be resolved, the entry will be deemed ineligible. Any other attempted form of entry is prohibited; no automatic, programmed, robotic or similar means of entry are permitted. 

REQUIREMENTS FOR VIDEO ENTRIES

(a) Videos must be the original work of the entrant. Entries may incorporate only the facial likeness or name of the Entrant and must not incorporate the facial likeness or name of any other person.

(b) Videos must be under 60 seconds in length.  

(c) Videos must not infringe on the copyrights, trademarks, privacy or publicity rights of any person, or other rights of any person or entity.  Videos cannot contain or promote the products or services of any company or entity or contain trademarks or logos, or promote any brand or product, other than WWE and Mountain Dew trademarks, logos, brands and products. 

(d) Videos cannot contain content that is offensive, inappropriate, hazardous, indecent or obscene, profane, or defamatory, libelous, slanderous or disparaging.  Videos cannot be sexually explicit or suggestive, contain full or partial nudity, pornographic material or content that is disparaging to any ethnic, racial, general, religious, professional or age group.

(e) Sponsor may, in its sole and absolute discretion, disqualify any photo that it believes violates any of the foregoing requirements or otherwise fails to comply with these Rules. 

(f) As a condition of entry, each entrant agrees to indemnify and hold the Releasees (as defined below) harmless from and against any and all claims or liability to a third party that arise out of the content of any photo submitted in this Sweepstakes, or the entrant’s failure to comply with these Official Rules. 

By submitting a video entry, entrant grants Sponsor a royalty-free, irrevocable, perpetual, non-exclusive license to use, reproduce, modify, publish, create derivative works from, and display such entry in whole or in part, on a worldwide basis, and to incorporate it into other works, in any form, media or technology now known or later developed, including for promotional or marketing purposes.  If necessary, entrant will sign any necessary documentation that may be required for Sponsor or its designees to make use of the non-exclusive rights entrant is granting to use the video entry.

NO PURCHASE NECESSARY. A purchase will not increase your chances of winning.

ELIGIBILITY: Sweepstakes open only to legal residents of the forty-eight (48) contiguous United States and the District of Columbia, who are at least eighteen (18) years old when they enter the Sweepstakes.   Employees, officers and directors of WWE (including WWE performing talent), Pepsi–Cola Company ,  and their respective subsidiaries, affiliates (i.e., entities controlling, controlled by or under common control with, WWE or PepsiCo, Inc.), promotion and advertising agencies and anyone involved in the Sweepstakes development or execution, and the immediate family members (meaning spouses, parents, siblings, children and their respective spouses) and members of the households of such employees, officers and directors are not eligible. By taking part in this Sweepstakes participants agree to be bound by these Official Rules. WWE reserves the right to permanently disqualify from this Sweepstakes any person it believes has intentionally violated these Rules. This Sweepstakes is subject to all federal, state and local laws. VOID WHERE PROHIBITED.

DRAWING: The Grand Prize Winner shall be selected at random from among all eligible entries received. The random drawing shall take place on or about 9/13/2017 by WWE or its designee, Woobox, whose decisions are final and binding on all aspects of this Sweepstakes and not subject to appeal. The potential winner will be contacted by direct message on Twitter within approximately one (1) business day after being selected. Winner will be required to claim his or her prize within twenty-four (24) hours of the time the winner notification is sent. To claim the prize, the selected Grand Prize winner must respond to the prize notification message via direct message to the designated e-mail account. Grand Prize Winner may be required to provide additional information to confirm identity and eligibility and also may be required to complete and sign an Affidavit of Eligibility, a Liability Release, IRS Form W-9,  and, where legal, a Publicity Release, and any other documentation that WWE may require and to see to it that WWE is in receipt of such information and documents within one (1) day of being requested to provide the same. If the selected Grand Prize Winner is a minor in his or her state of residence at the time he or she is asked to sign any document, the minor’s parent or legal guardian also will be required to sign the documents. In all cases, WWE reserves the right to request proof of identity, residency, age and parenthood or guardianship, and the winner will be deemed to have forfeited the prize if WWE, in its sole discretion, finds that the proof is unsatisfactory. The prize will be forfeited (i) if the selected Grand Prize Winner does not timely provide the requisite information, does not return the requisite documents or cannot be reached within one (1) business day from initial notification attempt, (ii) if prize is returned as non-deliverable, and/or (iii) in the event of non-compliance with any of the requirements of these Official Rules.

GRAND PRIZE: One (1) Grand Prize Winner will receive two (2) tickets (seat location at the discretion of Sponsor) to WWE No Mercy (the “Event”) currently scheduled for September 24, 2017 at Staples Center in Los Angeles, California (the “Event City”), round-trip economy class air transportation for the Grand Prize Winner and one (1) guest between major commercial airport nearest winner’s permanent residence and the Event City (flight designated by Sponsor); two (2) nights hotel accommodations (one (1) standard room, double occupancy at hotel designated by Sponsor); ground transportation between airport and hotel and between hotel and Event venue (ground transportation provider at discretion of Sponsor).  Approximate retail value (“ARV”) of the Grand Prize package: $2,000.00 USD. The ARV is determined as of the date of the printing of these Official Rules. The difference in the value of the prize as stated herein and value at time of prize notification, if any, will not be awarded. Winner and his/her guest must be available to travel to the Event City on the dates designated by Sponsor.  In the event the winner lives within one hundred fifty (150) miles of the Event City, Sponsor will provide the Winner and guest  (traveling together) with round-trip ground transportation between the Grand Prize Winner’s residence and the Event City in lieu of the round trip coach air transportation from the major commercial airport nearest the Grand Prize Winner’s residence.  The dollar value difference between the round trip economy class air transportation and ground transportation will not be provided to the Grand Prize Winner.  Grand Prize Winner is solely responsible for any and all expenses and incidental travel costs not expressly stated in the prize description herein, including, but not limited to, ground transfers between Grand Prize Winner’s residence and airport of departure, ground transportation (not stated herein), in-room charges (e.g., mini-bar, room service, telephone, movies), meals and beverages, gratuities, travel upgrades, baggage fees, and personal incidentals. Grand Prize Winner will be required to provide a valid major credit card or some other acceptable form of payment, as determined in the hotel’s sole discretion upon hotel check-in and all in-room charges, telephone calls, meals, beverages, hotel upgrades, amenities, personal incidentals and any other expenses charged to the Grand Prize Winner’s and guest’s hotel rooms will be charged to that major valid credit card or deducted from the deposit provided.  The ARV of the prize may vary based on the commercial airport nearest Grand Prize Winner’s permanent residence, as well hotel fluctuations at the time of travel.  Grand Prize Winner and guest must travel on dates designated by Sponsor and on the same itinerary.  In the event the Grand Prize Winner and guest cannot travel on dates designated by Sponsor, the Grand Prize Winner will be disqualified and the Grand Prize may be awarded to an alternate winner in a random drawing from among all remaining eligible entries provided sufficient time remains prior to the Event.  Sponsor is not responsible for any fees or additional charges resulting from the Grand Prize Winner’s or guest’s changes to itinerary or accommodations. Travel is subject to the terms and conditions set forth in these Official Rules and those set forth by selected travel providers, availability and other material restrictions may apply. In the event, for whatever reason, the Event is cancelled prior to the trip or during Grand Prize Winner’s trip, that portion of the prize will not be awarded and Sponsor will not provide any compensation or substitution for that portion of the prize. 

In the event the Grand Prize Winner is considered a minor within the jurisdiction from which he/she resides, Grand Prize Winner must be accompanied to the Event by a parent or legal guardian, who must attend the Event at his or her own expense, unless such parent or legal guardian is the Grand Prize Winner’s chosen guest. If the Grand Prize Winner is at least twenty-one (21) years old, the Grand Prize Winner may attend the Event with a guest who is under the age of majority if: (a) the parent or legal guardian of the guest has executed an Authorization Form, giving consent, a Liability Release and, where legal, a Publicity Release, on the guest’s behalf; and (b) WWE, in its sole discretion, has granted its approval. In all cases, the Grand Prize Winner’s guest, or the parent/legal guardian of any guest who is a minor in his or her state of residence, will be required to sign a Liability and Publicity Release (except where prohibited by law). Sponsor shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by the air carriers, hotels or other transportation companies or any other persons providing any of these services and accommodations to passengers including any results thereof such as changes in services or accommodations necessitated by same. Sponsor shall not be liable for any loss or damage to baggage.  If the Grand Prize Winner becomes disabled or cannot otherwise fully enjoy the prize due to illness, Sponsor shall have the option at its sole discretion of being relieved of liability for fulfillment of the prize award and no other compensation in lieu of the prize will be awarded. Grand Prize Winner and guest are responsible for obtaining their own medical and life insurance and the associated costs.   All travel is subject to any and all restrictions instituted by the Department of Defense and/or Department of Homeland Security, as required.  Grand Prize Winner and guest agree to comply with all applicable venue regulations in connection with the Event.   WWE and venue representatives reserve the right to remove or to deny entry to Grand Prize Winner and/or his/her guest(s) who engage(s) in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the game, event or exhibition. Releasees will not be responsible for Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster outside their control that may cause the cancellation or postponement of any WWE event or exhibition.

All expenses not specified in these Official Rules, including, without limitation, taxes and insurance are solely Grand Prize Winner’s responsibility.  Grand Prize Winner shall be responsible for all applicable federal, state and local taxes including but not limited to any sales and income taxes.  Prizes may not be substituted, transferred or redeemed for cash, except by WWE, who reserves the right to substitute similar prize of comparable or greater value in its sole discretion.

Approximate retail value (“ARV”) of all Grand Prizes: $2,000.00 USD.
All expenses not specified in these Official Rules, including, without limitation, taxes and insurance are solely Grand Prize Winner’s responsibility.  Grand Prize Winner shall be responsible for all applicable federal, state and local taxes including but not limited to any sales and income taxes.  Prizes may not be substituted, transferred or redeemed for cash, except by WWE, who reserves the right to substitute similar prize of comparable or greater value in its sole discretion.

ODDS OF WINNING: Odds of winning depend on the number of eligible entries received.

GENERAL CONDITIONS: Sweepstakes entrants agree to be bound by the terms of these Official Rules and decisions of WWE which are final and binding on all matters relating to this Sweepstakes. By entering, participants (and parent/legal guardian if participant is a minor) release and hold harmless WWE,  Pepsi-Cola Company and each of their respective parent companies, subsidiaries, affiliates, representatives, promotion, advertising and online technology agencies, prize suppliers and all others associated with the development or execution of this Sweepstakes  and each of their respective owners, shareholders, directors, officers, employees, contractors and agents (the “Releasees”) from any and all liability or any injuries, loss or damage of any kind arising from or in connection with participation in this Sweepstakes (including with respect to the creation of any video) or acceptance, use, misuse or nonuse of any prize or parts thereof (including activity or travel related thereto), including, without limitation, liability for death, personal injury, damage or loss of any kind, and from liability to any other persons relating to or resulting from entering or downloading materials or software in connection with this Sweepstakes  The Releasees do not make any warranty, representation or guarantee, express or implied, in fact or in law, relative to the use of any prize, including, without limitation, quality, merchantability, and fitness for a particular purpose. Further, no responsibilities are accepted for any additional expenses, omissions, delays, re-routing, or acts of any government or authority. WWE reserves the right to modify this Sweepstakes in any way it deems necessary or appropriate and to cancel this Sweepstakes if it deems necessary or appropriate.  Entry constitutes permission for WWE and its designees to use winner’s name, likeness, performance, hometown and state for advertising and promotional purposes in any and all media at the discretion of WWE without additional compensation unless prohibited by law.

INTERNET: The use of any automated launching or entry software or any other mechanical or electronic means that permits the participant to automatically register and/or enter repeatedly is prohibited. If for any reason this Sweepstakes is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes for any reason. Should this Sweepstakes be terminated, Sponsor reserves the right to select the Grand Prize Winner in a random drawing from among all eligible, non-suspect entries received as of the action requiring such termination. Releasees assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Releasees are not responsible for lost, late, garbled, misdirected, or postage due entries or mail, or for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participation in this Sweepstakes or downloading any materials in this Sweepstakes  CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

Requests must be received by December  31, 2017.

MISCELLANEOUS: Participants agree that this Sweepstakes is governed solely by the laws of the United States. Any claims arising out of the Sweepstakes shall be governed solely by United States law and may be brought only in a federal or state court in Connecticut. If any provisions of these Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect. SUCH CLAIMS SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION, AND ALL SUCH CLAIMS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, BUT IN NO EVENT TO INCLUDE ATTORNEYS’ FEES.
